Purchasing regulations effective 01.01.2018 in accordance with RODO

xl-narzedzia.pl is an online store, available in the domain xl-narzedzia.pl, operated by 24usb.pl Wojciech Osielski with headquarters in Kąty Rybackie at 30 Rybacka Street, NIP: 579-211-02-37, with which customers can contact at the following email address sklep@24usb.pl.

1. 24usb.pl Wojciech Osielski conducts retail sales electronically via the Internet. Orders are accepted only through websites available in the domain xl-narzedzia.pl

2. Customers have the opportunity to use xl-narzedzia.pl without registration and creating an account or by registering and thus creating an account, in which data and information about the Customer relating to his/her activities at xl-narzedzia.pl are collected (hereinafter: „Account”) . Provision of services under the Account on xl-narzedzia.pl is of unlimited duration. The customer has the right to terminate the agreement concluded with 24usb.pl Wojciech Osielski concerning the Account, at any time by notifying the store by e-mail, telephone or in writing. The above does not apply to situations in which 24usb.pl Wojciech Osielski is in the process of completing an order placed by the Customer. In such a case, the effect of termination of the contract will occur at the time of completion of the order in question.

3. In order to register the creation of an Account at xl-narzedzia.pl, it is necessary to complete the registration form by providing the following data: e-mail address and password. A message indicating how to confirm registration and other information required by law will be sent to the Customer's e-mail address placed in the registration form. The moment the registration is confirmed, an agreement on running the Account is concluded between the Customer and 24usb.pl Wojciech Osielski, the subject of which are the services provided by 24usb.pl Wojciech Osielski, under the conditions specified in the Terms of Use.

4. In the case of a legal person and an organizational unit without legal personality, all actions of this entity at xl-narzedzia.pl, may be performed only by a person who is authorized to perform on behalf of this entity all actions related to the use of xl-narzedzia.pl and to exercise all rights and obligations of this entity as a Customer.

5. All products available at xl-narzedzia.pl are brand new, free from physical and legal defects, and have been legally introduced into the Polish market.

6. All prices listed on xl-narzedzia.pl website are gross prices (including VAT). A VAT invoice is issued for each product sold. By purchasing from 24usb.pl Wojciech Osielski in any sales channel, the Buyer agrees to send an invoice electronically if he provides an email address.

7. The ordered product is delivered with the help of specialized postal operators (courier companies). In some cases, it is possible to collect the products in person at Personal Collection Points, the list of which is indicated on the xl-narzedzia.pl website. The customer bears the delivery costs specified on the card of each product and summarized in the shopping cart before making a purchase at xl-narzedzia.pl

8. The agreement concluded between the Customer and 24usb.pl Wojciech Osielski concerning the purchase of a given product at xl-narzedzia.pl is of a term nature and lasts for the duration of the order. The place of performance related to the purchase of products at xl-narzedzia.pl is the delivery address indicated by the Customer, with the exception of products collected in person by the Customers, in which the place of performance is the Personal Collection Point selected by the Customer.

9. In a situation where there are large differences in the lead time or method of packaging and delivery of individual products comprising a single order placed under xl-narzedzia.pl, 24usb.pl Wojciech Osielski may independently decide to divide the order into smaller shipments. In such a case, the overall cost of delivery given to the Customer when placing the order is not changed, but only divided into individual partial shipments. In case of cancellation of a part of the order, only those delivery costs assigned to the undelivered or advertised part of the order are adjusted.

10. The customer is obliged to pay the price for the product ordered at xl-narzedzia.pl, including the cost of delivery, no later than 7 days from the date of conclusion of the contract, subject to when payment is made on delivery. The following forms of payment are possible:

o On delivery – payment in cash to the courier upon receipt of the product or at the cash desk of the personal collection point. In selected cases 24usb.pl Wojciech Osielski reserves the right to additional telephone verification of such orders.

o By wire transfer - a form of payment for customers who prefer to log in to an online bank by themselves or visit a bank branch. After placing an order, the customer receives by electronic mail (e-mail) the bank account number to which the correct amount should be transferred. Once the payment is credited to the bank account of 24usb.pl Wojciech Osielski, the order is transferred for execution.

o By online transfer or payment card – The operator of payment cards and online transfers is PayPro SA Settlement Agent, ul. Kanclerska 15, 60-327 Poznań, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto and Wilda in Poznań, VIII Economic Department of the National Court Register under KRS number 0000347935, NIP 7792369887, Regon 301345068.

11. For some types of assortment available at 24usb.pl Wojciech Osielski reserves the right to limit the payment method by not providing certain payment and delivery options.

12. The delivery time of the products is no more than 30 days from the date of conclusion of the contract. The date of receipt of shipment is each time the time of completion of the order plus the time of delivery.

In case of personal collection, shipments are delivered to the designated Personal Collection Point. 24usb.pl Wojciech Osielski informs about the possibility of collecting the ordered product by e-mail or telephone. The shipment must be picked up within 2 days of receiving information about the possibility to pick up the product. A shipment that is not collected within the specified time will be sent back to the warehouse, and the order will be corrected.

13. Products may come with a manufacturer's, importer's or seller's warranty valid in the territory of Poland. The warranty period of each product can be seen in its description on xl-narzedzia.pl. Detailed warranty terms are specified in the warranty form issued by the guarantor, available in the „warranties” tab in the description of each product. Most products have warranties fulfilled directly by authorized manufacturers' service points. The exact addresses of the service points can be found on the warranty cards attached to the products and on the manufacturers' websites.

Address and all necessary information will be provided when assigning an RMA number. Thanks to the RMA number, the processing of requests by 24usb.pl Wojciech Osielski will take place efficiently, however, providing the RMA number is not a prerequisite for processing the Customer's request. Repaired product is sent back to the Customer at the expense of 24usb.pl Wojciech Osielski The warranty for the sold product does not exclude, limit or suspend the rights of the buyer under the warranty for product defects.

14. 24usb.pl Wojciech Osielski is responsible for product defects on the basis of applicable law. For sales that are not consumer sales, the warranty provisions of the Civil Code are excluded.

15. Complaints under warranty may be submitted electronically to the address complaints(małpa)24usb.pl or in writing to 24usb.pl Wojciech Osielski given in the upper part of the Terms and Conditions, after prior assignment of the RMA number of the application, in accordance with Article 13. Information about the type of forwarder, and the address to which the product should be sent will be given during the assignment of the RMA number.

16. The Customer has the right to demand a reduction in price or withdraw from the contract, unless 24usb.pl Wojciech Osielski immediately and without excessive inconvenience to the Customer will replace the defective product with one free of defects or remove the defect. This limitation does not apply if the product has already been replaced or repaired by 24usb.pl Wojciech Osielski, or 24usb.pl Wojciech Osielski did not replace the product with a defect-free one or remove the defect.

17. 24usb.pl Wojciech Osielski recognizes the warranty complaint within 14 days from the date of receipt in its correct form. If within 14 days 24usb.pl Wojciech Osielski does not respond to the demands of the Customer, it means that it recognized the demands as justified.

In any of the above cases, when the implementation of the Customer's demands involves the delivery of a new or repaired product, the cost of delivery shall be borne by 24usb.pl Wojciech Osielski In order to send back the purchased product, the Customer should write on the waybill, in the field „declared value" (or equivalent), the purchase price of the returned product. This amount is a declaration of the insurance value.

18. In accordance with applicable laws, within 14 days of receipt of the ordered product, the consumer has the right to return it without stating reasons, with the proviso that services and products, the purchase of which, in accordance with applicable laws, cannot be withdrawn, are not subject to return. The rules of withdrawal from the contract, including a model form on withdrawal from the contract, which the customer may use, are located in the shipping subsection returns.

19. The customer has the right to return used equipment in accordance with the Law of July 29, 2005 on Waste Electrical and Electronic Equipment. Return of used equipment may take place only if the purchase of a new product will be made at 24usb.pl Wojciech Osielski and will include a product of the same type. Willingness to return a used product should be reported by e-mail to sklep@24usb.pl within a period of not more than one month from the purchase of a new device, but not less than 14 days from its purchase. The return is made after 24usb.pl Wojciech Osielski verifies the Customer's purchases and assigns an individual RMA number to such return, which will be done within 5 working days from the date of notification. The Customer shall send the used equipment to the 24usb.pl Wojciech Osielski warehouse indicated in Article 13, at his own expense.

20. The information contained on the website of the 24usb.pl Wojciech Osielski store does not constitute an offer within the meaning of the Civil Code. The customer placing an order using the mechanisms available on the web pages of the store 24usb.pl Wojciech Osielski, makes an offer to purchase a specific product under the conditions specified in the product description.

21. The personal data provided by Customers 24usb.pl Wojciech Osielski collects and processes in accordance with applicable laws and in accordance with the Privacy Policy contained on the xl-narzedzia.pl website. The customer making a purchase at 24usb.pl Wojciech Osielski agrees to the processing of e-mail address for the purpose of sending a survey allowing to express an opinion about the transaction made at 24usb.pl Wojciech Osielski. The e-mail address will be processed by 24usb.pl Wojciech Osielski and Allegro Group Sp. z o.o. in order to send the survey, and the data received as a result of the survey will be used to publish on the Internet opinions about 24usb.pl Wojciech Osielski.

22. 24usb.pl Wojciech Osielski may change the Terms and Conditions and launch a new version of the services provided under xl-narzedzia.pl. The change shall become effective on the date indicated by 24usb.pl Wojciech Osielski, which shall not be shorter than 7 days from the moment the amended Regulations are made available at xl-narzedzia.pl, with the provision that orders started before the effective date of the changes are carried out on the previous terms.

23. The customer at the first login to xl-narzedzia.pl counting from the time the changes take effect will be notified of such changes and the possibility of accepting them. Refusal to accept the changes is equivalent to termination of the contract with 24usb.pl Wojciech Osielski.

24. In matters not regulated Polish law shall apply.

25. Any disputes related to the services provided by 24usb.pl Wojciech Osielski under xl-narzedzia.pl will be settled by the common courts. A customer who is a consumer has the opportunity to use an out-of-court way of dealing with complaints and claims before the Permanent Consumer Arbitration Court at the Provincial Inspector of Trade Inspection in Gdansk.
